Why would this be illegal? Your salary can change. It’s allowed to. They get one salary for six months then an increase in salary.
It’s just something I’ve never encountered even at a startup, which is what this is. Apparently it’s very common practice to do this in China (where everything is HQ right now). They are out of compliance on FICA/FUTA taxes with employees, out of CA compliance on pay periods, no workman’s comp in CA/NV so I had to ask if this salary thing is even allowed. In nearly 10 years of HR in various places I’ve never seen it. I’ve seen things like “if your performance is good you may get a raise at month x”; but never withholding a 15% salary due to probation period. If it’s not illegal, cool but if it is; I don’t want to be on the hook of litigation should something wrong happen.

Employers can set the salary and terms at whatever they want and as long as the employee agrees and understands, it shouldn't be an issue. I agree, a bit odd, but I don't think it would violate any kind of employment laws.
I mean it's unconventional...but I don't think it's illegal? Probation terms can vary and although these sound a bit harsh, not really sure how you can prove that it's illegal?

All in office 5 days a week cramped in a WeWork. Company doesn’t pay parking, slashed benefits to $300 per employee across medical/dental/vision (one employee has $800/mo premiums on health alone). Turnover rate is 140%. They are trying to get the bonuses back from those laid off by 12/31. I’m GTFO of here asap. Leadership won’t tell me anything (budgets, layoffs, even after asking) and if I land in a courtroom and can’t explain any of their actions that’s a problem.
