In the state of Michigan if a parent demands an eval we have to do a Reed within 10days. We try and make sure that gen ed interventions have been tried for 6-& weeks and data collected, but in the end if a parent demands an eval…we do it. But, a sped evaluation does not necessarily amount to certification and services.
Read the procedural safeguards. A parent has the right to request an evaluation for a variety of reasons. Based upon your hunch is an example of power. The professional opinion needs to provide a PWN that explains why the district is electing to not evaluate the student. Hopefully that will include data and the growth from interventions that are currently in place from MTSS.
A part of the problem is at the high school level districts are trying to push kids out rather than provide more support. An IEP provides support until 21.
There are so many students who miss out of transition programming because of a lack of evaluation. It effects their ability to have access to Medicaid support and social security that may be needed. Other agencies trust in the integrity of evaluations by schools to help show evidence of needs.
Unilateral determinations violates that students right to FAPE.
Not feeling like it isn’t needed isn’t professional. That student’s educational rights are based upon professional ego, rather factual data. One persons opinion can be the difference between someone getting needs met or pushing them into the pipeline of prison or homelessness.

In New York, a parent can request an eval anytime. Sometimes they go right to the CSE office and I don’t know they’ve requested anything until I get forms to fill out in my mailbox. It starts the clock - once we have that signed paper, we have 60 days to complete an eval and have an initial evaluation meeting. Usually if the eval comes from left field for a kid who isn’t in my radar, they don’t qualify for an IEP. Sometimes, I’m completely shocked by the testing results and feel so grateful the parents requested that eval!
Where I work - the school psychologist does all the testing and writes the report. I usually have to fill out some rating scales but my work doesn’t begin until a student qualifies and I need to write the new iep (if they qualify).
Get data. If the child is making effective progress in school then the school can say they don’t see the need
