I suggest speaking to the paralegal in person first. I would start by making sure they understand that when you give them edits, they need to incorporate those edits into the original document they drafted. This should be fairly obvious, but maybe they thought they were suggestions and not required. And then instead of saying they can send/file after making the edits, ask for them to send to you for a final look first to make sure all of your edits were incorporated. If you continue to have issues with the same thing after that, I would discuss with your partners. Some people are never going to get it no matter how much training they get.
Good point thank you for this
The paralegal prepared a stipulation for me. I reviewed it, made revisions and sent it back to be executed and filed. Later in the week I needed an identical stip for another case. I noticed they used the original template I had edited so I remade the revisions, forwarded it saying the version was ok and moved on with my day.
Opposing counsel cc’d me on the executed version and upon reviewing it I realized the para had sent the original unedited stipulation. After reviewing the first stipulation, I noticed they did the same and did not file the one with my edits.
Thankfully both were minor consenting for an extension of time but I am annoyed about the situation.
I don’t have any particular suggestion, but I completely completely empathize with this situation. I get half-ass work for some of the support staff (that is WAY different from what I know they give to partners). I don’t have any suggestions, but I completely commiserate with this infuriating situation.
Everyone makes mistakes. You can't hold an employee to a standard of perfection as the condition for keeping their job. If you paralegal had three or four of these brain farts a year, it would be reason enough to have a serious sit down and discuss whether this is a good career choice for them. If you get two or three of these in a month, then there's a performance issue that needs to be addressed before it creates significant turmoil. So far you have seen examples of the paralegal not following simple instructions, twice. Luckily, it was stipulations which means you weren't having to convince the other side that you know what you're talking about. Having these types of errors in written documents could cast doubt on YOUR competence. For that reason, you cannot just rock on and hope the paralegal learns from their mistakes. Their mistakes could cost you and your client the case. Have a meeting, tell them you will meet with them again in six months, and tell them you will meet with them again in six months after that -- if they are still there.
I had a very similar situation and what sticks out to me is that you say the partners love this person. My solution was just to stop working with them. I tried bribing, gifts, additional communication— everything. It boiled down to she knew she could do what she wanted with me because the partners had her back. I stopped dealing with her and don’t let her touch my stuff.
