I don’t like or agree with it. But, I’ve worked for 2 Music PROs and that the exemption that they can exercise.
This is straight from Pokémon’s newest game Pokopia and Pokemon even came out and denied permission to use this. So how is this legally acceptable???
They don't need permission. The purpose is to be a parody, the work is transformative, and it doesn't deprive the copyright owner of any income or undermine a new or potential market. This makes it entirely and legally defensible under Fair Use.
Are we certain they didn't get permission? I'm sure they are figuring that if they get a cease and desist, they already got the promo out of it so who really cares?
Yeah Pokemon came out and said they didn’t ask and don’t approve. My issue is if the government sets this precedent, why can’t all businesses operate without rules like this? Can I use this at my company? No, because we’d get sued.
It's because they're immature goons and they don't care about anything. They figure the rules don't apply to them, and because of how the system is structured, they're often right. They do take things down sometimes if they get a cease and desist letter, but they make sure to waste everyone's time on that first.
I would love to use this for my company but unfortunately we’re forced to follow the rules 🙃

They've released statements both times, but have probably decided it's not worth taking legal action.
