I wouldn’t personally fall over myself to tell them I was terminated, which I have been in this spot before, however do not lie about it if it does come up. As said before, it probably won’t come up unless it was over something serious. I would prep some answers though if it does come up.
It depends on what type of check they run. Some companies only run criminal checks, but some also do employment verification. If you fill out the background check authorization and they have you list your employers, job titles, dates of employment, etc., then they verify your employment history. The thing you need to be concerned about is whether you’re eligible for rehire. Usually a background check verifies your dates of employment and whether you’re eligible for rehire. Most companies won’t disclose any information beyond that.
If you were fired for unsatisfactory performance, you’re probably safe, but if you were fired for misconduct or a serious policy violation, you’re probably not eligible for rehire and that will come up in the background check.
The only 2 questions they are allowed to ask:
- can you confirm the dates and title of employment for John / Jane Doe?
- Is John / Jane doe eligible for rehire?
That’s it.
Now that doesn’t mean that they might not ask for more details, and/or that whoever responds to them might not give them more details. But that’s what they’re legally allowed to ask for.
Whether the company answers yes or no to that second question may depend on the circumstances of your separation.
They won't be able to know if you are terminated but they are allowed to ask if you would be eligible for rehire and if the company you worked for says no that is going to raise red flags. If you can get ahead of it in some way its better to do that then to leave them to assume.
