I was downsized by this company 6 years ago and had worked for them for 8 years prior. I am now in talks with them about another oppertunity but they do not want to let me start back with those 8 years. I looked up standard practice and according to the standards at the Society of Human Resources Management HR should give me my time back cause I was downsized (not fired for cause and I did not quit). What should I do?

I don’t believe they have to follow standard practice if it’s not law. If you don’t negotiate that in your offer it probably won’t happen. Let them know you have another offer on the table and that accepting this role will be contingent on if they’re willing to work with you on the number of years.

Of course they don’t need to but if its standard practice according to an accredited society it justifies me asking for it. Im just trying to figure out if they don’t budge is it a slap in the face again and should I even go back.

What is the benefit of getting that time back? Can you negotiate whatever you really want separately without counting that time?

The one year thing is what they are saying they do. But when I was there people who had come back got there time back and I was even told if I came back they would give it to me when they laid me off. And I am pretty sure there was no policy on that at all written formally. I requested to see that policy but have not been given it yet because I don’t believe one exists.

I would stand firm on it, or negotiate a significant salary increase.

You should negotiate for a salary increase. I think a 15-25% increase would be reasonable.

Job transition question: I recently accepted an offer for a new role with Merrill Lynch, the following day I was fired from my previous employer. I haven’t filled out the updated work history background check info yet. The reason for termination was due to performance expectations not being met. So my work has unlimited PTO -global company. I'm based in uk and line manager is in USA. he said I'm taking to much time off and has brought it up with upper management. I have taken in total to date 22 days with 8 (4 include an operation) more to go. My performance is above target. I just feel blindsided.

I book an average of 3-5 demos per week. People always show up, but the thing that worries me is that I do not have a way to track how many meetings I book in our CRM,and to be honest I feel like I didn’t get the best training overall. Should I start looking somewhere else? Thoughts?
